Distance Sales Agreement

011. Parties

Seller: ForgeBorn ("Seller" or "we"), operator of forgeborn.ai. Contact: support@forgeborn.ai. The Seller's full legal title, registered address and tax details are stated on the checkout page and on your invoice.

Buyer: the customer ("Buyer" or "you") whose identity and contact details (name, e-mail address) are provided through their ForgeBorn account at the time of purchase.

By completing a purchase on this website, the Buyer confirms that they have read, understood and accepted this Agreement and the pre-contractual information within it.

022. Subject of the Agreement

This Agreement sets out the rights and obligations of the parties regarding the sale and performance of digital services offered by the Seller on forgeborn.ai — namely subscription plans with a monthly credit allowance and one-time credit packs used to generate AI images and videos.

033. Services and Price

The essential characteristics of each plan and credit pack (credit amount, features, validity) and their prices are displayed on the Pricing page at the time of purchase. The price stated at checkout, including any applicable taxes, is the total amount payable by the Buyer.

Subscription plans renew automatically each billing period at the then-current price until cancelled from the account settings. One-time credit packs are single purchases and do not renew.

044. Delivery and Performance

The services covered by this Agreement are digital content and digital services; no physical delivery takes place. Performance begins immediately after payment is confirmed: the purchased plan and/or credits are applied to the Buyer's ForgeBorn account electronically and without delay.

The Buyer can verify performance at any time from their account dashboard, where the active plan and current credit balance are displayed.

055. Payment

Payments are collected online at checkout by credit or debit card through our licensed payment service provider, iyzico (iyzi Ödeme ve Elektronik Para Hizmetleri A.Ş.). The Seller does not store full card details; card data is processed by the payment provider in accordance with its own security certifications (PCI-DSS).

066. Right of Withdrawal

Under the Regulation on Distance Contracts, consumers normally have the right to withdraw from a distance contract within 14 days. However, pursuant to Article 15/1(ğ) of the Regulation, the right of withdrawal does not apply to services performed instantly in an electronic environment and to digital content delivered immediately with the consumer's approval.

By purchasing, the Buyer expressly acknowledges that performance begins immediately upon payment and consents to the immediate delivery of the digital service, and therefore accepts that the statutory right of withdrawal is lost once performance has begun.

Notwithstanding the above, unused one-time credit packs may be refunded within 14 days of purchase as described in our Delivery & Refund Policy, provided none of the purchased credits have been spent.

077. Obligations of the Parties

The Seller undertakes to perform the service in accordance with this Agreement, the Terms of Use and the descriptions on the website. The Buyer undertakes to provide accurate account and payment information and to use the service in accordance with the Terms of Use and the Acceptable Use Policy.

If a generation fails due to a technical error on the Seller's side, the credits spent on that generation are automatically returned to the Buyer's balance.

088. Complaints and Disputes

The Buyer may submit any request or complaint to support@forgeborn.ai or through the contact page; the Seller will respond as promptly as possible.

For disputes arising from this Agreement, consumers residing in Türkiye may apply to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) or the Consumer Court at their place of residence or at the Seller's registered address, within the monetary limits announced annually by the Ministry of Trade. Mandatory consumer protection rules of the Buyer's country of residence remain unaffected.

099. Effectiveness

This Agreement is deemed concluded and enters into force when the Buyer approves it electronically during checkout and completes the payment. A copy of this Agreement can be accessed on this page at any time.
